These Terms and Conditions set out the basis on which Rubbish Removal Brent provides rubbish removal, waste collection and related services. By making a booking, confirming an order, or allowing our team to commence work at your premises, you agree to be bound by these Terms and Conditions.

1. Definitions and Interpretation

In these Terms and Conditions:

Customer means the individual, business, landlord, tenant or organisation requesting the rubbish removal or waste collection service.

Company means Rubbish Removal Brent, the service provider supplying the services.

Services means the rubbish removal, waste collection, clearance, loading, transportation and disposal services that the Company agrees to carry out for the Customer.

Waste means all items, materials, goods, refuse and rubbish which the Customer asks the Company to remove, subject to these Terms and Conditions and applicable waste regulations.

Contract means the agreement between the Company and the Customer formed in accordance with these Terms and Conditions.

Worksite means the address or location at which the Services are to be performed.

2. Scope of Services

The Company provides rubbish removal and waste collection services for domestic, commercial and other premises. The precise scope of the Services, including the estimated waste volume, type of items to be removed, date, time and price, will be agreed with the Customer during the booking process.

The Services may include the loading of Waste from within or outside the Worksite, transportation to a licensed waste transfer or disposal facility, and lawful disposal or recycling of Waste in accordance with applicable regulations.

The Company does not undertake building work, dismantling of fixed installations, disconnection of utilities or any other work beyond the agreed rubbish removal and waste collection activities, unless expressly agreed in writing.

3. Booking Process

3.1 The Customer may request a booking by telephone, email or online enquiry. The Company may request details including the Worksite address, access information, description of Waste, approximate volume, photographs, and preferred dates and times.

3.2 Any price or availability given before the Company has seen the Waste is an estimate only, based on the information supplied by the Customer. The final quotation will be confirmed when the team arrives at the Worksite and inspects the Waste.

3.3 A booking is not confirmed until the Company has accepted the booking, agreed a service date or time window, and provided confirmation verbally or in writing. The Company reserves the right to refuse any booking at its discretion.

3.4 The Customer must ensure that a person with authority to approve any revised quotation is present at the Worksite when the team arrives. If nobody is present, the Company may, at its discretion, proceed only where the scope and price have been clearly agreed in advance.

4. Access and Customer Obligations

4.1 The Customer must provide safe, reasonable and timely access to the Worksite, including any necessary entry codes, parking permissions and instructions. The Customer is responsible for obtaining any permits or consents required for access or loading near the premises.

4.2 The Customer must ensure that the Waste to be removed is clearly identified and separated from any items that are to be retained. The Company is not liable for removing items that were not clearly identified as excluded from the clearance.

4.3 The Customer warrants that they own the Waste or have the full authority of the owner to arrange for its removal. The Customer shall indemnify the Company against any claim by a third party alleging unlawful removal of property.

4.4 The Customer must ensure that the Worksite is reasonably safe for the Company’s staff to operate, including clear walkways and, where possible, adequate lighting. The Company may refuse to carry out all or part of the Services if, in its reasonable opinion, the Worksite presents unacceptable health and safety risks.

5. Pricing and Payments

5.1 Prices are normally based on the volume, weight and type of Waste, the time required on site, and any access difficulties or special handling requirements. Unless otherwise stated, prices include loading, transportation and lawful disposal of Waste.

5.2 The Company will confirm the final price with the Customer before commencing the removal. If the actual volume or nature of Waste is significantly different from that originally described by the Customer, the Company may revise the quotation accordingly.

5.3 Payment is due on completion of the Services on the day, unless the Customer has an agreed credit account. The Company accepts payment methods as communicated to the Customer at the time of booking, which may include cash, card payments or bank transfers.

5.4 Where credit terms are agreed, invoices shall be payable within the period stated on the invoice. The Company reserves the right to charge interest on late payments at the statutory rate permitted under applicable UK legislation, and to recover the costs of debt collection.

5.5 All prices quoted are exclusive of any applicable taxes, unless otherwise stated. The Company will apply any relevant taxes in accordance with UK law.

6. Cancellations, Rescheduling and Waiting Time

6.1 The Customer may cancel or reschedule a booking by providing reasonable notice to the Company. Unless otherwise stated, at least 24 hours notice before the agreed arrival window is required to cancel without charge.

6.2 If the Customer cancels with less than 24 hours notice, or if the team attends the Worksite and is unable to carry out the Services for reasons beyond the Company’s control, the Company may charge a cancellation or call-out fee to cover travel time and administration costs.

6.3 If the team is kept waiting on arrival because access is not available, Waste is not ready, or instructions are unclear, the Company reserves the right to charge a reasonable waiting time fee, or to leave the Worksite and treat the visit as a cancelled booking.

6.4 The Company may cancel or reschedule the Services if it is affected by circumstances beyond its reasonable control, including severe weather, traffic disruption, staff illness, vehicle breakdown or similar events. In such cases, the Customer will be offered a new appointment time and the Company will not be liable for any consequential loss.

7. Waste Types and Prohibited Items

7.1 The Company will collect and dispose of general household, garden and commercial Waste, and certain bulky items such as furniture and appliances, in line with applicable waste regulations.

7.2 Some items are classed as hazardous or require special handling, such as chemicals, asbestos, medical waste, gas bottles, oils, paints and certain electrical items. The Customer must declare any such items in advance. The Company may refuse to remove any item it reasonably considers to be hazardous or illegal to transport or dispose of.

7.3 If prohibited or undeclared hazardous items are discovered among the Waste, the Company may refuse to proceed with the job, revise the price, or remove only the non-hazardous portion. Any additional costs associated with handling or rectifying such items may be charged to the Customer.

7.4 The Customer is responsible for ensuring that the Waste description provided at the time of booking is complete and accurate. The Company accepts no liability for delays or price changes arising from incomplete or misleading information.

8. Waste Handling and Regulatory Compliance

8.1 The Company operates in accordance with applicable UK waste management and environmental legislation. All Waste collected will be transported to appropriately licensed facilities, and disposal or recycling will be carried out in a lawful and responsible manner.

8.2 The Company may provide the Customer with documentation evidencing the lawful transfer of Waste, such as waste transfer notes, when required by law or as agreed between the parties.

8.3 Title to the Waste passes to the Company when it has been loaded into the Company’s vehicle, provided that the Customer has the authority to transfer such title and that the Waste is lawful to possess, transport and dispose of.

8.4 The Company is not responsible for any items left at the Worksite that were not clearly presented and designated as Waste at the time of collection.

9. Liability and Limitations

9.1 The Company will exercise reasonable skill and care in providing the Services. However, the Customer acknowledges that some risk of minor scuffs, marks or scratches may arise when removing heavy or bulky items from confined spaces. The Customer should take reasonable steps to protect floors, walls and fixtures where possible.

9.2 The Company’s liability for damage to property caused by its negligence will be limited to the reasonable cost of repair or replacement, subject to evidence of the damage and its value. The Company shall not be liable for pre-existing damage, wear and tear, or deterioration caused by conditions at the Worksite.

9.3 The Company will not be liable for loss of profit, loss of business, loss of opportunity or any indirect or consequential loss suffered by the Customer arising out of or in connection with the Services.

9.4 Nothing in these Terms and Conditions shall exclude or limit the Company’s liability for death or personal injury caused by its negligence, for fraud or fraudulent misrepresentation, or for any liability that cannot lawfully be excluded under UK law.

9.5 The Customer is responsible for checking the Worksite at the end of the job, where practicable, to ensure that all required Waste has been removed and that no items intended to be retained have been taken away. Any issues should be raised with the team on site or with the Company as soon as reasonably possible.

10. Insurance

The Company maintains insurance coverage appropriate for a rubbish removal and waste collection business, including public liability insurance. Details of cover limits may be provided to the Customer on request. The Customer remains responsible for insuring their own premises and possessions.

11. Customer Data and Communication

11.1 The Company will use the Customer’s contact details to manage bookings, carry out the Services, issue invoices and communicate about any queries or follow-up matters.

11.2 The Company may keep records of communications, bookings and work carried out, in accordance with its data handling practices and any applicable data protection legislation. The Customer is responsible for ensuring that their contact details are accurate and up to date.

12. Complaints and Disputes

12.1 If the Customer is dissatisfied with any aspect of the Services, they should contact the Company as soon as possible, providing full details of the issue, the Worksite address and the date of the job.

12.2 The Company will investigate complaints in a fair and timely manner and may request photographs, receipts or other supporting information. Where appropriate, the Company may offer to revisit the Worksite, rectify the issue, provide a partial refund, or take other reasonable steps.

12.3 If a dispute cannot be resolved between the parties by informal negotiation, either party may pursue their rights through the courts or any other dispute resolution process that may be agreed in writing.

13. Amendments to Terms

The Company reserves the right to amend these Terms and Conditions from time to time. The version applicable to a particular booking will be the version in force at the time the Contract is formed. The Customer is advised to review the Terms and Conditions before confirming each new booking.

14. Governing Law and Jurisdiction

These Terms and Conditions, and any dispute or claim arising out of or in connection with them, the Services or the Contract, shall be governed by and construed in accordance with the laws of England and Wales.

The courts of England and Wales shall have exclusive jurisdiction to settle any dispute or claim arising out of or in connection with these Terms and Conditions, the Services or the Contract, subject to any mandatory statutory rights the Customer may have as a consumer.

15. General Provisions

15.1 If any provision of these Terms and Conditions is found to be invalid, unlawful or unenforceable by a court of competent jurisdiction, that provision shall be deemed severed from the remaining provisions, which shall continue in full force and effect.

15.2 No failure or delay by the Company in exercising any right or remedy under these Terms and Conditions shall constitute a waiver of that or any other right or remedy.

15.3 The Customer may not assign or transfer their rights or obligations under the Contract without the prior written consent of the Company. The Company may assign or subcontract its rights and obligations where reasonably necessary to deliver the Services.

15.4 These Terms and Conditions constitute the entire agreement between the Company and the Customer in relation to the Services and supersede any prior representations or agreements, whether written or oral, relating to the same subject matter.
